When you make a booking with Embassy Camps we enter into an agreement which is based on our booking conditions as well as other information contained within our online Parent Information. It is important that we build a positive relationship, and we know what to expect from each other. You should have high expectations from Embassy Camps, if things go wrong or we do not quite meet these expectations, for any reason, we will work hard to put things right – you can discuss your booking with our Customer Experience Team via our telephone number +(60) 3-2287 4722 or our email info@embassy.camp.
We reserve the right to make changes to this Terms & Conditions at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Terms & Conditions. Any changes or modifications will be effective immediately upon posting the updated Terms & Conditions on the Site, and you waive the right to receive specific notice of each such change or modification.
You are encouraged to periodically review this Terms & Conditions to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Terms & Conditions by your continued use of the Site after the date such revised Terms & Conditions is posted.
1. CONDITIONS APPLICABLE
1.1. These conditions shall apply to the contract to the exclusion of all other terms and conditions.
1.2. Embassy Camps reserves the right to update these conditions from time to time by notifying you in writing of the updated conditions. Any updated conditions shall not apply to any existing bookings but shall apply to any new booking made more than 30 days following notification to you of the updated conditions.
1.3. No variation to these conditions (including any special terms and conditions agreed between the parties) shall be binding unless agreed in writing between us and you.
1.4. Any representations made by Embassy Camps or by our employees or agents concerning the booking shall not be incorporated into the contract unless confirmed in writing by us and in entering into the contract you acknowledge that you do not rely on and waive any claim for breach of any such representations which are not so confirmed.
1.5. Any typographical, clerical or other error or omission in any sales literature, leaflet, quotation, price list, acceptance of offer, booking confirmation, invoice or other documentation issued by Embassy Camps shall be subject to correction without any liability on our part.
1.6. The details published in various brochures and leaflets are compiled from up-to-date and accurate information available at the time of going to press (the print date appearing in each brochure or leaflet).
2. PAYMENT TERMS AND BOOKING CONFIRMATION
2.1. The agreement between you and Embassy Camps will commence when payment is made, in part or in full, and is when these booking conditions take effect from. The agreement is between Embassy Camps and the person who made the booking, if this person is not the parent or guardian of the child(ren) attending then it is your responsibility to ensure they understand these booking conditions. Bookings made online, via phone or via email will be confirmed by email.
2.2. Your booking confirmation will include what you have booked, please check it, including the dates, location and child details. Responsibility for all booking details lies with the person making the booking. If your confirmation is not what you expected please tell us within 48 hours and we’ll change it if we can or refund you if we can’t.
2.3. Embassy Camps accepts payment by all major debit/credit cards, Paypal, Bank Transfer, Cash at the HQ account. Transaction fees charges may apply.
3. PRICING, DISCOUNTS & OFFERS
3.1. All current pricing is displayed clearly on the Embassy Camps website and will indicate what the current saving is against our rack rate. The rack rate is our normal pricing before any discounts are applied.
3.2. We may operate various promotions throughout the year, which could mean that the current price is less than what you paid originally. We are unable to apply an offer price to any booking retrospectively, so if the current price is less than what you paid originally then you will not be entitled to a refund on the difference.
3.3. All discount codes must be applied at the time of booking and cannot be applied retrospectively.
4. BOOKING CANCELLATIONS
4.1 The Organizer reserves the right to charge penalties for late cancellations as follows:
100% penalty for cancellations made less than 14 days before the program start date;
75% penalty for cancellations made less than 20 days before the program start date;
50% penalty for cancellations made less than 25 days before the program start date;
25% penalty for cancellations made less than 45 days before the program start date;
A processing fee of 100 USD (one hundred US dollars) will be withheld from any refund regardless of the circumstances of the cancellation.
4.2 A security deposit of 200 USD is required prior to the participant’s check-in. This deposit will be refunded in full provided that the participant has caused no damage to the camp/ school/ hotel property. In the event of damage, the cost of repairs or replacement will be deducted from the deposit before the remainder is returned.
5. PROGRAMME & ACTIVITY AMENDMENTS
5.1 Itineraries, programmes and transportation services are subject to alteration due to weather or operational factors beyond our control and we reserve the right to substitute alternative itinerary other facilities or services of reasonably equal or better standard without prior notice or liability and without any alteration to the price.
5.2 Camps and transport routes are subject to minimum numbers and availability. We reserve the right to withdraw or substitute any of these services where we consider there are insufficient numbers to reasonably facilitate them.
6. YOUR RESPONSIBILITIES
6.1 Participation in activities requires individuals to be in good physical and mental health and have a reasonable basic level of fitness and a willingness to take part.
6.2 You will be required to complete the ‘Health Declaration Form’ at time of booking or by logging into your account once booking has been made. This must be completed BEFORE we can accept your child at camp. We reserve the right to exclude any child arriving at camp where completed child information questions have not been completed prior to their arrival at camp.
6.3 Children will be required to ensure that their behavior is compatible with the orderly conduct of activities and that minimal disturbance to other visitors is caused and children are required at all times to follow the verbal and/or written instructions of our staff.
6.4 Children are required to be fully toilet trained and out of nappies/pull ups prior to attending one of our camps. We reserve the right to exclude a child if during their time at camp in our opinion this is not the case based on multiple toileting incidents during their time on camp.
6.5 You and your child shall at all times take such precautions as shall be necessary and/or as maybe reasonably required by us to prevent or restrict the spread of infectious or contagious diseases e.g., chicken pox, gastro enteritis, covid-19. In particular (and without limitation) you are required to advise us if your child has suffered from or been in contact with other persons or animals suffering from infectious or contagious diseases representing any threat to human health within the period of 4 weeks prior to the arrival date at Camp in which case we shall be entitled to cancel the booking of the child and the appropriate cancellation charges applied.
6.6 We reserve the right to decline to accept or to cancel any booking or exclude any child at any time prior to the arrival date or between the first date and the last date of the booking, if in our reasonable opinion the behavior of that child is or may be disruptive, dangerous, inappropriate or incompatible with the general enjoyment of other visitors. This may include when a child presents with a special educational requirement which was not disclosed prior to arrival. If we exclude a child, the parent will not be entitled to a refund for any unused portion of the programme. Behavior deemed inappropriate may include but is not limited to:-
6.6.1 Leaving the site unless accompanied by a member of our staff;
6.6.2 Threatening behavior including offensive or insulting language to other visitors or our staff;
6.6.3 Suspected involvement with drugs or alcohol;
6.6.4 Fostering an inappropriate relationship with another camper;
6.6.5 Willfully leaving allocated areas without good reason;
6.6.6 Inappropriate use of mobile phones, cameras or video equipment;
6.6.7 Theft, vandalism or illegal activities;
6.6.8 Inappropriate behavior;
6.6.9 Bullying (in any form) which adversely affects the enjoyment of other visitors.
6.6.10 Injury to staff.
6.6.11 All children are expected to abide by these rules and conditions as per listed above & as per but not limited to the camp rules document signed during registration to our camps.
6.7 You must arrange for your child to be collected as soon as reasonably possible from when we contacted you. Any additional costs so incurred shall be entirely your responsibility and you shall reimburse any costs reasonably incurred by us in connection with the exclusion of your child (to include costs of arranging alternative care and/ or transportation). A refusal to collect your child at the camps request will result in a notification to the Head of Safeguarding who will follow the safeguarding procedures.
6.8 In the event that a Child is dismissed from the Camp due to misconduct, or if the Camp term has concluded and the Parent/Guardian refuses or fails to arrange for the Child’s immediate departure, additional charges shall apply. This charge covers the continued cost of 24-hour supervision, specialized staffing, room, and board etc.. Furthermore, the Parent/Guardian shall be responsible for all additional costs incurred by Embassy Camps, including but not limited to, rebooking transportation and any additional fees or legal/ administrative fees associated with the delay. Embassy Camps reserve the right to involve relevant local authorities or child welfare services if a child is not collected within 24 hours of the mandated departure time.
6.9 It is your responsibility to inform us at the time of booking or as soon as You become aware of any actual or anticipated disabilities, social or behavioral problems or circumstances (including details of past experiences) affecting your child where such problems or circumstances may affect your child’s stay (including the provision of any transportation services), the stay of other visitors and the ability of our staff to support your child appropriately. This may include but is not limited to mobility or medical problems, diagnosed conditions such as ADHD or Asperger’s Syndrome, past difficulties experienced such as being excluded from school or extended periods being cared for away from parents. If we believe that we need to make reasonable adjustments to our usual programme or pastoral care or transportation arrangements of a child we will carefully consider matters with reference to social compatibility, physical access, successful participation and health and safety. All information provided will be treated sensitively and confidentially. We are committed to making our holidays accessible to as many guests as possible but very occasionally we may not be able to provide the service required. Where such information is provided to us promptly and as required under these conditions and we cancel any booking made you shall be entitled to a full refund of any deposit or part of the price relating to the affected part of the booking.
6.10 If a child has any additional needs you must notify us at the point of booking. The additional needs will need to be disclosed to us before your child’s stay. We reserve the right to cancel a booking without a money refund if we cannot successfully meet the needs of the child. The health, safety and welfare is of paramount importance.
6.11 We reserve the right to exclude any child or cancel the booking for any child at any time prior to the arrival date or between the arrival date and the departure date if we in our absolute discretion have reason to believe that important information has not been provided to us. In such circumstances Cancellation Charges shall be payable as set out in clause 4.
6.12 Where we provide transportation as part of the booking you and/ or your child shall abide by the Travel Rules. Failure to do so may result in our declining to provide transportation services for your child or in making alternative transportation arrangements at your cost. Serious breach may result in exclusion of your child in accordance with clause 6.5. All transport routes are
subject to minimum numbers and availability, and times may change depending on operational requirements. Any changes to routes or times will be notified to you as soon as is reasonable and where possible a suitable alternative will be provided.
6.13 Supervised off-site visits may be included in some of our programmes. If you do not wish your child to participate in such off-site visits it will be your responsibility to inform us prior to the arrival date.
6.14 Insurance: Embassy Camps does not hold ‘Personal Accident Insurance’ or variances of for the children attending the Camp. From time-to-time injuries may occur whilst taking part in the programmes and as such we would recommend that you have adequate personal/travel insurance to cover such incidents. Please note that Embassy Camps is unable to assist, advise or recommend any insurance products in any territories in which we operate.
6.15 Embassy Camps maintain strict staff-to-child ratios in accordance with international safety standards to ensure adequate supervision. For all off-site excursions or high-risk activities, enhanced supervision ratios and dynamic risk assessments are implemented. While we take every precaution to ensure safety during transport and external visits, parents acknowledge that these activities carry inherent risks associated with travel and public spaces.
6.16 In the event of an emergency, injury, or illness, the Parent/Guardian hereby authorizes Embassy Camps and its staff to seek and consent to any medical examination, diagnosis, or treatment (including X-ray, anesthetic, blood transfusion, or surgery) for the child as deemed necessary by a licensed medical professional. While every effort will be made to contact the Parent/Guardian immediately, Embassy Camps is authorized to act in the child’s best interest if the Parent/Guardian is unreachable.
6.17 Embassy Camps is committed to the safety and wellbeing of all participants. All staff members undergo rigorous background checks, including criminal record clearances (DBS or local equivalent), and receive mandatory training in Child Protection and Safeguarding protocols. We maintain a designated Safeguarding Lead at all times. By enrolling your child, you agree to comply with our safeguarding policies, which may include restrictions on parent/guardian access to certain areas of the camp for security purposes.
7. COMPLAINTS
7.1 If any problem is experienced between the arrival date and the departure date the matter should be immediately reported to the Camp Manager to allow us the opportunity to rectify any problem raised. If it is not resolved you should write to us within 28 days of the your child’s final day and we will endeavor to find a satisfactory solution.
8. RISK ACKNOWLEDGEMENT
8.1 Participating in Embassy Camps activities is a great way for children to have fun and learn new skills. While we do everything we can to ensure a safe environment, there are some natural risks involved, such as minor injuries or exposure to outdoor weather conditions.
8.2 By enrolling your child(ren) in our programmes, you acknowledge that:
8.3 You understand and accept that, despite our best efforts to maintain safety, some risks are a part of activity camp and outdoor education activities.
8.4 You agree that Embassy Camps and its staff will do everything possible to keep activities safe by following strict safety procedures and providing appropriate supervision, and as such Embassy Camps and its staff shall not be held liable for any accident or injury that may occur.
8.5 You recognize the importance of helping your child understand the need to listen to instructions, wear any safety equipment, and behave responsibly during activities.
8.6 Embassy Camps is committed to providing a fun, engaging and safe experience for all children. Thank you for your support and trust.
9. LIABILITY
9.1 Our liability hereunder (except in respect of death or personal injury caused by our negligence or that of our employees or agents which is not limited or excluded by these conditions) for any delay in performing or any failure to perform any of our obligations in relation to the booking shall be limited to the excess (if any) of the cost to you in the cheapest available market of similar services to replace those not performed over the price.
9.2 In all cases except where personal injury, illness, or death results our liability is limited to a maximum of twice the price (excluding insurance premiums and amendment charges).
9.3 Except in respect of death or personal injury caused by our negligence or that of our employees or agents we shall not be liable to you by reason of any representation or any implied warranty condition or other term or any duty at common law or under the express terms of the contract for any consequential loss or damage, (whether for loss of profit or otherwise) costs, expenses, or other claims for consequential compensation whatsoever (and whether caused by our negligence or that of Embassy Camps’s employees or agents or otherwise) which arise out of or in connection with the booking except as expressly provided in the conditions.
9.4 Subject as expressly provided in these conditions all warranties, conditions, or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
9.5 You shall indemnify us and keep us indemnified from and against any and all direct and indirect loss, damage, costs, claims, demands, or liability (whether criminal or civil) arising out of any injury or other loss to us or our employees, guests, visitors, or agents resulting from your negligence or breach of the contract unless we are liable for the same under these conditions.
9.6 While Embassy Camps maintains high safety standards and follows strict operational procedures, it shall not be held liable for any personal injury, loss, or damage to property arising from the inherent risks of camp activities, except where such injury or loss is the direct result of gross negligence or a breach of duty by Embassy Camps or its employees. Parents acknowledge that outdoor and physical activities involve a degree of risk that cannot be entirely eliminated.
9.7 Data Security and Third-Party Hacks: Embassy Camps implements industry-standard administrative, technical, and physical safeguards designed to protect the personal information and data provided to us. However, the Parent/Guardian acknowledges that no method of transmission over the internet or electronic storage is 100% secure. While we follow best practices to prevent unauthorized access, Embassy Camps cannot guarantee absolute security against sophisticated cyberattacks, ‘hacks,’ or third-party data breaches. To the maximum extent permitted by law, Embassy Camps shall not be held liable for any damages, losses, or identity theft resulting from a data breach, provided that Embassy Camps has maintained reasonable security measures and was not grossly negligent in its data handling procedures.
10. PERSONAL PROPERTY
10.1 You and Your Child must take all appropriate measures for the protection and security of any valuables, baggage or other personal possessions.
10.2 We accept no liability for loss or damage to valuable, baggage or personal property unless such loss or damage is proven to be due to our negligence or that of our employees.
10.3 If any personal possessions are missing when your child leaves camp please let the Camp Manager know about immediately as there may still be time to find the missing property before camp closes down at the end of the season. Expensive and treasured items such as mobile phones, jewelry, CD players, mp3 players, I-pods, personal video games, digital cameras, designer clothes shoes/trainers etc. should not be brought to camp as they are unnecessary and inappropriate on a multi-activity camp.
10.4 We are unable to accept responsibility for mobile phones, personal computers etc. should they be lost or damaged during the camp program.
11. FORCE MAJEURE
11.1 We shall not be liable for any delay in performing or failure to perform any obligation (including auctioning any alteration or cancellation) due to any cause beyond our reasonable control including strikes, lock-outs, labor disputes, shortages of personnel, act of God, war, riot, civil commotion, terrorism, malicious damage, threats to safety, compliance with any law or governmental order, rule, regulation or direction, accident, environmental contamination, pandemic outbreak of disease, breakdown of plant or machinery, fire, flood, storm, difficulty or increased expense in obtaining workmen, materials, goods or raw materials in connection with the performance of this agreement.
11.2 Embassy Camps reserves the right to modify or cancel activities in the event of extreme weather conditions (including but not limited to heavy rain, lightning, extreme heat, or poor air quality etc.) that may pose a risk to the health and safety of participants. In such instances, indoor alternatives will be provided where possible. The camp’s primary priority in any Force Majeure event is the immediate physical safety of the children and staff.
12. PHOTOGRAPHY, MARKETING AND THE INTERNET
12.1 To ensure that our marketing materials give an accurate and honest impression of our camps. We use images of children attending previous camps in our marketing and promotional materials, including but not limited to, brochures, websites, and social media. If you do not wish images of your child to appear in our future marketing materials, please inform us via the child information question in your parent account prior to the arrival date so that we can ensure that your child is not included within any photographs which may later be used for marketing purposes.
12.2 Inappropriate use of or sharing of images or videos taken at camp is not permitted and may result in your child being excluded from camp.
12.3 Embassy Camps will exercise discretion in capturing and using photographs, and there may be instances where children are not photographed to maintain their privacy and safety.
12.4 Parents/guardians are encouraged to discuss any specific concerns regarding the use of photographs with Embassy Camps staff.
12.5 The use of photographs for marketing purposes will be done in a manner that prioritizes the safety and privacy of all individuals under our care.
12.6 Embassy Camps will not use or publish photographs in a way that compromises the safety or privacy of any individual.

12.8 In accordance with data protection regulations, Embassy Camps will only collect and store personal data (including medical information) for the purposes of ensuring the child’s safety and camp administration. All photographs or videos taken for marketing purposes and will be stored securely. Embassy Camps guarantees that images will not be sold to third parties or used in any manner that compromises the child’s dignity or privacy.
13. DATA PROTECTION
13.1 Personal information requested during the booking process is held digitally via our booking system and used by us in connection with the booking. Where necessary we share personal information with our employees, agents, subcontractors, franchisees and other third parties for the purpose of fulfilling our obligations under the contract. We take full responsibility for ensuring that proper security measures are in place to protect personal information. Please note the provisions of clause 11 in relation to the use of photographs.
14. AGENT REGISTRATION, MIS-SELLING LIABILITY, AND REFUNDS/CREDIT NOTES
14.1 Agent Registration:
14.1.1 Embassy Camps provides services through registered agents who have undergone a vetting process to ensure competence and accuracy.
14.1.2 A list of registered agents can be obtained by contacting at info@embassy.camp.
14.2 Mis-selling Liability:
14.2.1 Embassy Camps shall not be held liable for any mis-selling or inaccuracies in information provided by agents who are not registered with us.
14.2.2 Agents who are not registered with Embassy Camps are not authorized representatives, and their actions and representations are independent of Embassy Camps.
14.3 Refunds and Credit Notes:
14.3.1 Embassy Camps will not provide refunds, credit notes, or any form of compensation for services provided by unregistered agents, including any mis-selling or inaccuracies.
15. GENERAL
15.1 The headings in the conditions are for convenience only and shall not affect their interpretation.
15.2 We may perform any of our obligations or exercise any of our rights here under by ourselves or through our employee’s agent’s franchisees, subcontractors or affiliates.
15.3 No waiver by us of any breach of the contract by you shall be considered as a waiver of any subsequent breach of the same or other provision.
15.4 No failure by us to exercise any power given to us or to insist upon strict compliance by you with any obligation hereunder and no custom or practice of the parties at variance with these conditions shall constitute any waiver of any of our rights under the contract.
15.5 No person who is not a party to this contract has any rights under the contracts (Rights of Third Parties) Act 1999 to enforce any of these conditions, but this does not affect any right or remedy of a third party which exists or is available apart from under that act.
15.6 If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part that provisions shall apply with the minimum variation necessary to ensure enforceability and the validity of the other provisions of these conditions and the remainder of the provisions in question shall not be affected thereby.
15.7 The contract shall be governed by the laws of Malaysia and subject to the jurisdiction of the Malaysian courts.
16. GOVERNING LAW AND JURISDICTION
16.1 Any disputes arising during the performance of this Contract shall be resolved by the Parties through negotiations.
16.2 The Parties have the right to resolve disputed issues by entering into a supplemental agreement to the Contract.
16.3 In the event that the Parties fail to reach an agreement through negotiations or other out-of-court methods, the dispute may be settled in court, including at the place of registration and licensing of the Organizer, in the Kuala Lumpur Court of Arbitration, Malaysia.
ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION OR OTHER REPRESENTATIVE PROCEEDING. THIS WAIVER APPLIES TO CLASS ARBITRATION, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THIS TERMS OF SERVICE, YOU AND EMBASSY.CAMP ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, .COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.
